SOFTBALL IRELAND ACTIVITY WAIVER AND RELEASE OF LIABILITY

Issued by Softball Ireland as the National Governing Body for the sport of Softball on the Island of Ireland

Effective for the 2026-2027 Season

1. INTRODUCTION

This Activity Waiver and Release of Liability (“Waiver”) is executed by the undersigned participant (the “Participant”) in favour of Softball Ireland, its Regional Associations, affiliated leagues, clubs, teams, directors, officers, employees, volunteers, coaches, officials, sponsors, and event organizers (collectively, the “Activity Provider” or “Released Parties”).

By signing this Waiver, the Participant agrees to the terms outlined below as a condition of participating in any softball-related activity sanctioned by Softball Ireland, including but not limited to training, matches, tournaments, and other affiliated events (the “Activity”).

2. DETAILS OF ACTIVITY

The Participant will be engaging in softball activities scheduled from April 1, 2026, to March 31, 2027, organised and provided by the Activity Provider.

The Participant understands that participation in the Activity is voluntary and acknowledges the associated risks.

3. ACKNOWLEDGMENT AND ASSUMPTION OF RISKS

The Participant acknowledges that participation in softball involves inherent risks, including but not limited to:

  • Physical injuriesincluding sprains, fractures, concussions, and other impact-related injuries.
  • Risks associated with equipment, playing surfaces, weather conditions, and interactions with other participants.
  • Potential for serious injury or even deathin rare circumstances.

By signing this Waiver, the Participant voluntarily assumes all risks associated with the Activity, including those arising from the negligence of the Released Parties, except where such negligence amounts to gross negligence or wilful misconduct.

4. FITNESS TO PARTICIPATE

The Participant confirms that they:

  • Are physically fit and capable of safely participating in the Activity.
  • Have no known medical conditions that would limit or prevent participation.
  • Have sought medical advice if necessary.

If required, the Participant agrees to obtain medical clearance from a licensed medical professional before participating.

5. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by the laws of Ireland and Northern Ireland, the Participant waives, releases, and discharges the Released Parties from any and all claims, demands, actions, damages, liabilities, or expenses arising from participation in the Activity, except were caused by gross negligence or wilful misconduct of the Activity Provider.

The Participant understands that this Waiver is legally binding, and by signing it, they are waiving their right to sue or claim damages from the Activity Provider for injuries or losses sustained during the Activity.

6. INDEMNIFICATION

The Participant agrees to indemnify and hold harmless the Released Parties from any claims, losses, damages, or expenses (including legal costs) resulting from their participation in the Activity, including but not limited to claims by third parties due to their actions.

7. MEDICAL TREATMENT AND INSURANCE

  • The Participant consents to receiving medical treatment in the event of injury or illness during the Activity.
  • The Participant acknowledges that Softball Ireland does not provide personal accident or health insurance and is responsible for securing their own insurance coverage if desired.

8. COMPLIANCE WITH RULES AND CODE OF CONDUCT

The Participant agrees to abide by all rules, regulations, and Code of Conduct established by Softball Ireland and its affiliated organisations.

Failure to comply may result in disciplinary action, suspension, or removal from the Activity.

9. PARENTAL/GUARDIAN CONSENT (FOR PARTICIPANTS UNDER 18)

If the Participant is under 18 years of age, a parent or legal guardian must sign this Waiver, acknowledging and accepting the terms on behalf of the minor.

The parent/guardian agrees to assume all responsibility and liability for the minor’s participation.

10. GOVERNING LAW AND JURISDICTION

This Waiver shall be governed by and construed in accordance with the laws of both Ireland and Northern Ireland.

Any disputes arising from this Waiver shall be subject to the jurisdiction of the courts of Ireland or Northern Ireland, depending on where the Activity took place.
